My place is just a 5 minute drive to Sea World, 15 minutes to La Jolla for world class shopping or World Famous San Diego Zoo. Belmont Park is just a short walk. Downtown San Diego is just a 10 minute drive.
We have the best balcony and views in Mission Beach, located in the center of South Mission Beach at Deal Court. Very comfortable 3rd floor penthouse condo, with new kitchen, floors and paint through out. My place is good for couples, solo adventurers, business travelers, and families.

There are 4 adult beach cruiser bikes in the garage to use. You are responsible for them so be sure to use a lock if you take them out and leave them some place. You are still responsible for them @ $250.00 each.
The parking space is small (14'10") and fits a small/med car/compact SUV. If you are driving a larger vehicle there are 2 parking lots at each end of South Mission Beach. There is parking on the boulevard BUT please read the signs as there is street sweeping a couple times a week on each side. You will definitely get ticketed if you are on the side of the street they are sweeping between 8am-10am.

THEAPARTMENTASSOCIATION RULESANDREGULATIONS



1) INTRODUCTION

a) Our Rules and Regulations have been developed as a basis for good relations within The Apartment Association building (hereinafter “HOA”).The Rules and Regulations supplement the CC&R’s for the HOA. We trust we will have your complete cooperation not only to keep the HOA’s standards high and maintain a happy and friendly atmosphere, but also to assure each resident a maximum of convenience and comfort. The HOA will interpret and enforce these Rules and Regulations in a reasonable manner.

2) USEOFFACILITIES

a) Eachowner(s)ofaunitattheHOAisresponsiblefortheoccupantsofitsunit,its guests and tenants. Owner, occupant, guest and tenant may be used interchangeably throughout this document with Owner accepting primary responsibility. Owners, their guests and tenants have the right to use their own unit and HOA facilities only if they comply with these Rules and Regulations and the other provisions of the HOA’s governing documents. The HOA will attempt to promptly, equitably and impartially obtain the cooperation and compliance of all Owners with respect to the Rules and Regulations and other conditions of residency. Owner recognizes, however, that HOA’s ability to obtain compliance is dependent upon a number of factors, including the cooperation of all Owners, tenants and their guests.

3) GUESTS

a) AnOwnermustnotifytheHOAofficeifanygueststayslongerthanthirty(30)days.
Occupancyofaunitlongerthan30daysbyanon-Ownerrequiresthatthepersonfill out all necessary forms and paperwork to notify the Board of the occupancy.

b) Ownersagreetoprovidealloccupants,guestsandtenantswithconditionsoftenancy oftheHOA,includingbutnotlimitedto,theseHOA’sRulesandRegulations. Owner is personally responsible for all the actions and conduct of his or her guests, occupants and tenants.

4) CONDUCT

a) Quiet time is from 10 PM to 8 AM.

b) Actionsbyanypersonofanynature,whichmaybedangerousormaycreateahealth and safety problem or disturb others, are not permitted. This includes, but is not limited to, any unusual, disturbing or excessive noise, intoxication, quarreling, threatening, fighting, immoral or illegal conduct, profanity, or rude, boisterous objectionable or abusive language or conduct. The use or display of any weapon, including,butnotlimitedto,firearms,abowandarrow,BBguns,knives,fireworks andgunsareexpresslyforbidden. Personsundertheinfluenceofalcoholorany other substance shall not be permitted in any area of the Common Area, which is generally open to Owner’s and their guests.

c) Radios,televisions,recordplayers,musicalinstrumentsandotherdevicesmustbe used so as not to disturb others.

d) Allunitsaredesignatedasresidentialunitsandnobusinessmaybeconductedfrom the units.

e) Alltenants/ownersareresponsibleforthemaintenanceandupkeepoftheinterior and exterior of their units, including balconies/patios and drains in patios.

f) Thename,phonenumber,andemergencycontactinformationofboththeOwner and the Rental Agent must be submitted to the Board and kept current.

5) TENANTS

a) All leases must be provided to the Board within ten (10) days of execution.

b) For short term rentals, the name of tenants must be provided to the Board 24 hours before the tenants arrival and the Owner or an Owner representative must meet the tenant upon their arrival no matter the time or date. Failure to meet the tenant may subject the Owner to a fine at the Board’s discretion.


PLEASE BE AWARE THAT THE BOARD TAKES FAILURE TO MEET A TENANT UPON THEIR ARRIVAL VERY SERIOUSLY. IN ADDITION TO REGULAR FINES, FOUR OR MORE FINES ASSESSED TO A SINGLE UNIT IN ANY SIX MONTH PERIOD MAY RESULT IN AN ADDITIONAL FINE OF UP TO
$500, AT THE DISCRETION OF THE BOARD. (See the Violation Policy and
Schedule of Fines.)

c) The renting of any unit shall not be for less thanseven (7) days.

6) COMMONAREA

a)No banners, For Sale or For Rent signs, balloons, sales posters, etc. will be allowed in the Common Area. Signs can be no larger than 18”x24” and can only be placed in the unit window on a temporary basis.Signage must be of professional real estate signage.


b)All satellite dishes must be approved by the Board in writing as to size and location.
The Board will not allow any roof penetration unless approved by the Board in writing. The Owner with a dish will be responsible for damage, leakage, disruption caused by the placement of a satellite dish.


c)The Board will not allow any personal property, i.e. plants, bicycles, etc. to be placed in any Common Areas of the building without the Board’s consent.

7) LAUNDRYFACILITIES

a)Thelaundryfacilitiescanonlybeaccessedduringthehoursof8AMto10PM. Please see information posted in the laundry room.

b)Washers,dryers,andallotherlaundryfacilitiesaretobecleanedbyOwner,inside andout,immediatelyafteruse.Clothesaretoberemovedfromdryersassoonas they are dry. Dyeing may not be done in the washers. The laundry is to be left in a clean, neat and orderly condition. Pet laundry may not be done in washers.

8) PETS

a)AllOwnersandguestsarerequiredtoensurethattheirdogsarenotloosewithinthe building. Alldogsmustbeonaleash,whenoutsideofaresidence.Dogwasteisto be removed immediately. Owners shall monitor their dog or their visitor's dog so that barking is kept to a minimum and will not disturb the peace of neighbors.

b)The following rules must be strictly followed by all pet owners:

i)Eachpetmustbelicensedandinoculated inaccordancewithlocallawand evidence of such licensing and inoculations must be provided to the HOA on an annual basis.
ii)Petswillnotbeallowedtocauseanydisturbancewhichmightannoyneighbors, including, but not limitedto,barking,growling,biting,oranyotherunusual noises or damage. Under no circumstances are pets to invade the privacy of anyone’s home site, flowerbeds, decks, shrubs, etc.

9) BALCONIESANDPATIOS

a)Misuse of balcony or patio areas spoils the beauty of our complex.No miscellaneous storage is allowed in these areas including, but not limited to, boxes or flammable items.

b)No airing or drying of laundry, towels, rugs, etc. is permitted on balconies or railings.



10)WINDOWCOVERINGS

a)All window coverings, visible from the outside of the building or the common area, must be neutral in color. Neutral is defined as white or beige.All screens and exterior window coverings are to be kept clean and presentable.


11)PARKING/GARAGES

a)Vehicles must be parked in assigned spaces.Do not use another homeowner’s space except with written permission from the owner.Visitor parking is reserved only for homeowners. Homeowners parking may not be used by residents, even temporarily.

b)Owners are responsible for the cleanliness of the parking spaces.Vehicles leaking any fluids cannot be parked on the property

c) All vehicles must fit in the garage so the door will not cause damage when opening or closing. If vehicle does not fit, it must be parked on the street or one of the parking lots.Maximum length of vehicles is 15 feet 5 inches if the stop is removed. Maximum height is 6 feet (as posted above garage doors.) If a garage door is damaged, the Owner will be responsible forthe cost of any repairs.

d)Garage door combinations not to be shared with anyone except Owners/tenants. e)Assigned garage spaces may not be sublet or rented separately
f) Parking in either of the spaces on Deal Court is strictly forbidden as they belong to the owners of the building where located.

12)BICYCLES

a)Bicycles may only be stored in an Owners’ parking space with the understanding the bike is stored at the risk of the Owner and it does not impede parking of any vehicles. The Association is not responsible for damage or theft.

13)BBQ’s

a)Charcoal burners, fire pits, propane fuel containers greater than one pound and other open-flame devices shall not be used on balconies or within 10 feet of combustible construction.

14)TRASH/DUMPSTERS

a) All boxes to be broken down prior to putting in the dumpster at the southwest corner of the building.

b)All household trash must be in tied plastic bags before depositing in the dumpster. c) Dumpster combinations are not to be shared with anyone except Owners/tenants.
15)NOSMOKING

a)There shall be no smoking in the units, on the decks or on the balconies of any unit.

All Owners are responsible for making sure their tenants and guests understand and abide by this rule.
